Terms of Service

Welcome to Red Galaxy (the "Game", "Service"). These Terms of Service ("Terms") govern your use of the Red Galaxy game and all related services operated by Doganay Lab (Doğanay Ürgüplüoğlu, sole proprietor; the "Operator", "we", "us"). By downloading the Game, creating an account, or using the Service in any manner, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must not use the Service.

• "Account" — The user registration you create to access Red Galaxy.
• "Virtual Items" — Celestium, Red Matter, Mecha Token, Antimatter, Credits, ships, equipment, drones, and all other in-game digital items.
• "Content" — All graphics, code, audio, music, text, character designs, map data, and other copyrighted materials in the Game.
• "User Content" — User-generated nicknames, clan names, clan descriptions, chat messages, and other inputs.

2.1 Age Requirement

You must be at least 13 years old to use the Service. If you are under 13, you may not use the Game. If you are between 13 and 18, you may use the Service only with parental or legal guardian consent.

2.2 Account Responsibility

You are responsible for maintaining the confidentiality of your account credentials (username, password) and for all activities that occur under your account. If you detect unauthorized access, notify us immediately at contact@redgalaxygame.space.

2.3 Accurate Information

You must provide accurate information during registration. Accounts with false information may be suspended.

2.4 Single Account Rule

The Operator reserves the right to limit the number of accounts per user to prevent abuse.

The following are strictly prohibited and will result in permanent account suspension with no refund of Virtual Items:

3.1 Technical Violations

• Using bots, automation software, macros, or third-party tools
• Modifying, decompiling, or reverse-engineering the game client
• Knowingly exploiting bugs, glitches, or game defects
• Using or developing cheats
• Unauthorized server access attempts, DDoS, packet manipulation

3.2 Account and Economy Violations

• Selling, renting, transferring, or sharing your account
• Real-money trading (RMT) of Virtual Items
• Phishing other users for credentials
• Payment fraud, stolen card use, chargeback abuse

3.3 Community Violations

• Harassment, threats, hate speech, racism, sexism toward other users
• Sharing illegal, pornographic, or child-exploitation content
• Spam, advertising, promoting other games/services
• Impersonating Operator staff or moderators
• Using prohibited expressions in clan names, nicknames, or chat

3.4 Sanctions

Possible sanctions include: warning, temporary chat ban, temporary account suspension, permanent account suspension, IP-based ban. The Operator reserves the unilateral right to determine which sanction to apply.

4.1 Nature of Virtual Items

Celestium and all other Virtual Items have no real-world value, cannot be transferred outside the Game, and do not confer ownership rights. Virtual Items are merely a limited license for in-game use. When your account is suspended or deleted, your Virtual Items are forfeited without compensation.

4.2 Payment Providers

Purchases are processed via Google Play Billing or Xsolla. Their own terms apply, and you accept them as well.

4.3 Refund Policy

All purchases are final and non-refundable. By making a purchase, you acknowledge that the digital content is delivered immediately and you expressly waive your right of withdrawal (under EU Consumer Rights Directive 2011/83/EU Article 16(m) digital content exception, and equivalent provisions in Turkish Consumer Protection Law No. 6502).

4.4 Platform Refund Policies

You may request refunds under Google Play's or Xsolla's own refund policies. However:

• If Virtual Items (especially Celestium) have been spent, your Red Galaxy account will be reviewed even if the platform approves the refund.
• If fraud or abuse is detected during review, your account will be permanently suspended and all balances forfeited without compensation.
• Chargebacks automatically result in permanent account suspension, as they are treated as fraud.

4.5 Pricing

The Operator reserves the right to change the price and content of Virtual Items without prior notice. Previously purchased items are not affected.

4.6 Taxes

Virtual Item prices may include or exclude VAT and other taxes; this is indicated on the payment screen.

5.1 License

For any content you submit through nicknames, clan names, clan descriptions, chat messages, or other channels ("User Content"), you grant the Operator a worldwide, royalty-free, sublicensable, transferable license to use it as needed to operate the Service.

5.2 Responsibility

You are solely responsible for ensuring your User Content complies with applicable laws and does not infringe third-party rights.

5.3 Moderation Rights

The Operator reserves the right to delete, modify, or hide any User Content without prior notice if deemed inappropriate, illegal, harassing, or in violation of these Terms. This includes the right to forcibly change nicknames and clan names.

6.1 Ownership

All graphics, ship models, map designs, sound effects, music, source code, character designs, game mechanics, and other creative content of Red Galaxy ("Game Assets") are the exclusive property of the Operator and are protected by international copyright, trademark, and intellectual property laws.

6.2 Prohibitions

Without explicit written permission, you may not:

• Copy, reproduce, distribute, or republish Game Assets
• Create derivative works (excluding personal, non-commercial fan-art)
• Use assets in other games, applications, or projects
• Decompile the game client or extract source code
• Mint or sell Game Assets as NFTs, digital collectibles, or similar
• Use the Operator's trademarks (Red Galaxy name, logo, clan emblems) without permission

6.3 Limited License

The Operator grants you a limited, non-exclusive, non-transferable, and revocable license to play the Game for personal, non-commercial use. This license terminates automatically when you violate these Terms.

6.4 Fan Content

You are permitted to create personal, non-commercial fan content (screenshots, videos, fan-art). However, monetizing such content (excluding standard YouTube monetization) requires written permission.

6.5 Violations

The Operator reserves the right to permanently suspend accounts and pursue legal remedies for intellectual property violations.

7.1 User Deletion

You may request account deletion at contact@redgalaxygame.space. The deletion will be completed within 30 days. You may cancel the request during this period.

7.2 Operator Termination

The Operator reserves the right to suspend or permanently delete accounts that violate these Terms without prior notice.

7.3 Termination Consequences

Upon termination:

• All Virtual Items are forfeited without compensation
• Active premium subscriptions are not refunded
• User Content may be deleted
• Future account creation attempts by the same user may be denied

7.4 Data Retention

Some data may be retained for a limited period after account deletion for legal obligations (tax, fraud prevention). See our Privacy Policy for details.

8.1 Service Changes

The Operator reserves the right to modify game content, mechanics, balance, and features without prior notice, including the power balance, pricing, and availability of Virtual Items.

8.2 Service Discontinuation

The Operator reserves the right to discontinue the Service entirely. In such case:

• An announcement will be made at least 30 days in advance through in-game notifications and community channels
• There is no obligation to refund unspent Virtual Items, although the Operator may offer compensation at its sole discretion
• Account data will be deleted after legal retention periods

9.1 "As Is" Provision

The Service is provided "as is" and "as available". The Operator makes no express or implied warranties that the Service will be uninterrupted, error-free, secure, or virus-free.

9.2 Liability Cap

To the fullest extent permitted by applicable law, the Operator shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages (including lost profits, data loss, or Virtual Item loss).

9.3 Total Liability

The Operator's total liability to you shall not exceed the amounts you have paid in the 12 months preceding the claim.

9.4 Third Parties

The Operator is not responsible for performance or security issues of third-party services such as Google Play, Xsolla, or Discord.

You agree to indemnify and hold harmless the Operator from any claims, suits, and damages arising from your use of the Service, your violation of these Terms, or your infringement of third-party rights.

The Operator may update these Terms from time to time. Material changes will be announced at least 14 days before taking effect through in-game notifications and official community channels (Discord). Continued use of the Service after changes take effect constitutes acceptance of the updated Terms. If you do not accept, you must delete your account.

These Terms are effective as of 2026-05-04

12.1 Governing Law

These Terms are governed by the laws of the Republic of Türkiye.

12.2 Competent Courts

All disputes arising from these Terms or use of the Service shall be resolved by the Courts and Enforcement Offices of Sakarya, Türkiye.

12.3 Consumer Rights

This clause does not limit your rights under the mandatory consumer protection laws of your country of residence.

13.1 Entire Agreement

These Terms and the Privacy Policy constitute the entire agreement between you and the Operator.

13.2 Severability

If any provision of these Terms is held invalid, the remaining provisions shall continue in effect.

13.3 No Waiver

The Operator's failure to exercise a right does not constitute a waiver of that right.

13.4 Assignment

You may not assign your account or rights under these Terms. The Operator may assign these Terms and its operations to third parties.

13.5 Language

A Turkish version of these Terms is also published. In the event of any conflict between the Turkish and English versions, the Turkish version prevails.
